Although the Serbian tennis star have won in court against the immigration decision to deport him. He’s not totally free as the court decisions might still be overturned.

Novak Djokovic won his appeal against the Australian government's decision to cancel his visa and prepare him for deportation.

But how exactly did the Serbian managed to stop his deportation. We look into the key reasons that influence the judges' decision on freeing the Serbian tennis star.

When the Serbians' visa was cancelled by the government upon arrival for the Australian Open, the assertions was that the player’s recent Covid-19 infection did not sufficiently meet the requirements for him to be allowed to enter the country unvaccinated.

He was give about twenty minutes to contact his lawyers and anyone he might needed to support his case with. It was to be the saving grace for the Serbian in the end.

Upon the decisions, Djokovic spent the weekend in a hotel for visa detainees, while his lawyers worked on a legal case designed to overturn the ruling and allow him to compete in the tournament which he was a champion on nine previous occasions. 

The judge who sat on his case, Judge Anthony Kelly in his judgement said the government’s decision to cancel Djokovic’s visa was ‘unreasonable’ on the grounds that he was not given enough time to speak with his lawyers or representatives from Tennis Australia after being detained, and overturned the cancellation.

Now the ball is in the court of the Australian immigration minister, Alex Hawke, who have the power to decide whether to personally intervene in cancelling Djokovic’s visa himself.

This means that Ahis visa may still be cancelled.  The Home Affairs Minister can cancel his visa. They are currently looking at some of his information that doesn’t seem rightor seem right.

The initial decision was over turned on a technical issue of procedure than over information from the Serbian tennis star.
